The labor trial period in Peru and the adequate protection of constitutional rights

For the purpose of this research, it focuses on the study of the improper use of the trial period in Peru and its impact on the lack of protection of the constitutional rights of the worker based on the analysis of current legislation. The importance of this period is that it will determine the continuation of the employment relationship and with it the obtaining of employment stability, with the respective protection against arbitrary dismissal, failing that, the termination of the same for not having passed the test. For the development of the present investigation we have used surveys applied to the servers of the National Superintendence of Labor Inspection (SUNAFIL). As a result of the investigation carried out, it has been shown that there is a significant relationship between the labor trial period and the adequate protection of the constitutional rights of the worker in the private regime; being necessary to establish certain limits to arbitrary dismissal during the trial period, modifying the legal framework.
